Meeting with ED, Delhi--- GS, President, AGS, A. treasurer, press secy met Shri Manjit Singh, ED Delhi on 28th August and congratulated him on taking over as ED Delhi. Association representatives assured him with full cooperation in his endeavors to improve the services of MTNL Delhi and hoped that he will also take care of the problems of executives. ED also assured full co operation to the Association. Issues related to the services of MTNL were also discussed in details. ED assured to work on the suggestions given by Association. 

Other issues discussed are

1. Transfer of DEs/CAO to Mumbai--He showed his incapability in this issue because decision has been taken by CO.

2--Replacement of Garuda service connections of offcers with dolphin connection--He asked association to provide the  exact figure of such connections so that required decision can be taken . All officers who are willing to get their Garuda connection replaced with dolphin connection are requested to provide information to association.

NCOA had a fruitful meeting with Hon’ble Minister of Heavy industries & Public Enterprises, Shri Vilashrao Deshmukh on 27th August. Meeting was attended by Shri. Ashok Rao, President NCOA, Shri Baby Thomus, Secretary General, NCOA, Shri K.S.N.Raju, National Advisor, NCOA, Shri. V.K.Tomar, GS, MEA & Dy. Secretary General, NCOA. The paper presented to the minister is attached. He had a patient hearing and has agreed to work through the contents.

WE HAVE REQUESTED HIM TO ADDRESS THE PEOPLE OF PUBLIC SECTOR WHERE THERE IS A NEED TO TELL OUT THE POLICY OF THE GOVT. WITH REGARD TO DISINVESTMENT, MULTIPLE OWNERSHIP AND PLAN TOWARDS THE SICK INDUSTRIES. HE HAS AGREED TO HEAR US AND AGREED TO ADDRESS ONE OF OUR GATHERINGS.

FURTHER WE HAVE STRESSED THE NEED TO PLACE EXPERT AND PRACTICAL PEOPLE FROM PUBLIC SECTOR (RETIRED CMDS/DIRECTORS) ETC IN THE BOARD AS INDEPENDENT DIRECTORS. HE WAS POSITIVE TO THIS AND HAS REQUESTED TO GIVE A LIST OF PEOPLE FOR CONSIDERATION.

ON THE BASIS OF THE ABOVE IT IS REQUESTED THAT OA'S MAY SUGGEST GOOD PEOPLE WHO CAN RUN AND TURN AROUND PSE UNITS. THE FINAL LIST WILL BE GIVEN TO THE MINISTER FOR CONSIDERATION.

MEETING WITH CMD, MTNL--
Com. V.K.Tomar, GS, MEA & Com. A.K.Kaushik, GS, TEAM along with other office bearers met CMD on 18th Aug. and discussed following points.

  1. Pension issueCMD informed that in spite of strong presentation and persuasion by MTNL management before committee of secretaries, nothing positive has happened. Rather committee of Secretaries has raised many doubts and clarifications. Committee has once again raised the doubt about the repercussion on other PSUs. When Associations representatives expressed their concern and informed CMD that UF can again go on protest action, than CMD assured that he will discuss the matter further with Hon’ble Minister of Communication & IT, Cabinet Secretary & Secretary (LAW) by 15th Sep.
  2. Transfer of 12 DEs & 4 CAOs to Mumbai on their regular promotionAssociations took up this issue very strongly and demanded that these officers be retained back in Delhi as neither there is shortage of vacancies in Delhi, nor there is complaint against these officers. But, CMD was of the opinion that services of these officers are transferable to Delhi & Mumbai, So they should be prepared  to go any where in Delhi & Mumbai. After long discussion, CMD said that he will bring them back to Delhi after some time. But JF has requested him to consider these cases sympathetically and retain them back in Delhi.
  3. Pay revision & fixation as per DPE orders--    CMD told that he is ready to implement new pay scales as per DPE orders, but 30% fitment is not possible for MTNL, particularly in the absence of settlement of pension issue, and now the loss in last two quarters. JF maintained its stand of new pay scales with 30% fitment. So nothing could be decided in the meeting. Representatives told CMD that JF will wait upto Sep and discuss the matter further after the outcome of pension issue in Sep.
  4. Issues related to poor services of MTNL were also discussed in detail. GS asked CMD to take appropriate action to improve the services of MTNL and also implement the suggestions given by Association. CMD was convinced with the arguments of representatives and assured with positive steps in this regard
  5. ITS absorption issue- Associations demanded that ITS absorption issue should be settled immediately. CMD assured to take up the issue with DOT

Time has come when we have not to raise the fingure towards others alone, but to see the other fingures which are indicating towards us. We want to do things in a different way, for which we require a dedicated think tank in the Association, which can come out with the innovative ideas, and the ways how to get the things implemented to improve the financial viability of MTNL. Meeting with Dir (HR) --- GS along with AGS & OS met Dir (HR) on 07-08-09. Following points were discussed.

  1. Transfer of 12 DEs & 4 CAOs from Delhi to Mumbai on their regular promotionGS strongly pleaded the case and termed these orders as unwarranted and unjustified, and said that there was no valid reason in these transfer orders. Dir (HR) received all the arguments of GS in a very positive way and assured to discuss this matter with CMD.
  2. Regular DPC for promotion from JTO to SDEDir (HR) assured that DPC will be started very shortly. DGM (HR), who was also present in meeting, assured that DPC will be conducted at the earliest.
  3. Time bound financial up gradation from E5 to E6 to some officers of Mumbai, who were denied the same because of pending case of seniority in court of lawGS strongly pleaded that financial up gradation has nothing to do with the seniority. So, if they have completed the required service, than financial up gradation can not be denied. Dir (HR) & DGM (HR) were convinced with arguments and assured to settle the pending cases. As far as dropping of their names in promotion list is concerned, it will be further discussed with full facts and figures.
  4. Teaching allowance to left out officers in CETTMDir (HR) said that he is going to Mumbai; there he will discuss the matter with the concerned authorities and get it settled.
  5. Regularization of adhoc officers from the date of their adhoc promotion instead of the prospective date— GS argued that adhoc officers (DE/CAO) should have been promoted on regular basis from the date of their adhoc promotion. Because all these adhoc officers were promoted either by DOT or MTNL corporate office. These promotions were made against the justified sanctioned posts, and all procedures of regular promotion were observed while promoting them on adhoc basis. More over, these adhoc promotions were irreversible, so there is no point of giving one day break before giving them regular promotion. DIR (HR) said that they have done as per DOT guidelines/practice. But, he assured that efforts will be made to ensure that no one is put to a disadvantageous position. If required, appropriate decisions may be taken on case to case basis.

CEC meeting of Joint forum was held on 25th July in Kidwai Bhawan. Meeting was attended by all office bearers of MEA & TEAM. Meeting was addressed by both General Secretaries of MEA & TEAM along with other office bearers including com S.S.Nanda, Gen Secy Retired Officers Association & Com Virjesh Upadhyay, Gen Secy MTNL MS. GS, MEA elaborately described the whole pension issue and latest development on it. He said that because of persistent pressure from Joint Forum and United forum, meeting of committee of secretaries headed by cabinet secretary on MTNL pension issue has taken place on 23rd July. He also told that MTNL management has made a very strong presentation before the committee, but it is not still so easy to get the issue settled with the continuous opposition from Expenditure dept. He along with all speakers stressed on making the 29th July rally a grand success so that required pressure can be put on Govt. All officers are appealed to reach in this rally in full strength along with their sub ordinate staff. All area Secretaries/ Div Secretaries of both Associations are requested to make proper arrangement to bring all Executives & Non Executives to Jantar Mantar at 12 O’clock on 29th July.

GS MEA & GS TEAM alongwith other Office Bearers met Dir (HR) . Following issues were discussed –

  1. Extention of last date of pro-rata pension – Joint Forum representatives requested to extend the same because “pension at par with BSNL” issue is already in process. Dir(HR) told that date will be extended shortly.
  2. DPC for promotion to DE/CAO – Dir(HR) told that DPC was postponed due to unavailability of DPC members particularly Dir(Tech) & it is not linked with Qualification of Officers . Now DPC will be held shortly.
  3. Descrimination in Teaching Allowance to Officers in CETTM Mumbai -  Forum raised the issue that a large number of Officers are being denied teaching allowance in CETTM. Dir(HR) assured to look into the matter.
  4. Creation of more Hindi Officer Posts & regularization of Hindi Officer from retrospective dates   -  Forum asked for comprehensive discussion on this issue separately, so that a final decision can be taken in above mentioned matter. Dir(HR) informed that Corporate Office is making efforts to rationalize the Hindi Officer posts , he said that he will ask GM(HR) for detailed discussion on this issue.
  5. Chronic diseases – Forum served its strong resentment against the Corporate Office Order for limiting the reimbursement for treatment of chronic diseases to two months salary & appealed  for restoration of earlier arrangement. Dir(HR) assured to look into the matter.
  6. OPD Medical reimbursent- Forum protested against the order of MTNL CO about capping the ceiling of the Medical reimbursement to the salary of April 2008 & that too only for Executives. Dir(HR) assured to look into the matter.

GS, MEA  & GS, Team along with other representatives of Joint forum met secretary Dot & Jt secretary (T) on 12-06-09 in the for noon and discussed following points—
Status of pension issue- Secretary (telecom) informed that pension issue of MTNL is under consideration of committee of secretaries but yet no decision has been taken. He  said that he is trying his level best to get this issue settled as early as possible.
Revision of pension of pensioners in IDA scales after pay revision--      Secretary informed that this case is also under consideration of law ministry, but it will be settled shortly.

In the afternoon joint forum representatives met Dir (Fin), MTNL and discussed pension issue. Dir (Fin) apprised the Association representatives about the development on pension issue elaborately. She said that she and CMD were making all efforts to convince secretary (expenditure) and secretary (Pension). Secretary (expenditure) has sought certain information regarding the implication of pension issue in similarly placed PSUs where absorption has taken place after Sep 2000. Dir (F) has requested Jt Secretary (DPE) to provide this information. She said most probably they will again meet to Secretary (Expenditure) and Secretary (pension) shortly.

23-05-09 DPC for 55 JTOs was conducted long back for Offtg. Promotion to SDE cadre, but ED Delhi has refused to promote these JTOs because of shortage of JTOs. NOw GS has again met ED and asked him to promote these JTOs because promotion can not be denied on this ground. Ultimately ED has agreed and instructed GM(A) to isue the promotion orders immediately. Friends, now our struggle has gone in decisive Phase ( Phase-IV). This is really encouraging that all over Protest Action Programmes w.e.f. 23.03.2009 were huge success stories, as far as turn out & energy level is concerned. But still it is not enough for awakening management from their KUMBHKARAN sleep, hence we have to intensive our democratic protest struggle.All members are requested to be present at MTNL Corporate Office for whole day w.e.f. 0930 Hrs on 14th & 15th April for Relay Hunger Strike ( In case 14th declared holiday then hunger strike will be held only on 15th ). It is the responsibility of each member that participation should not be less than 100 %.

 Dismissal orders of two officers of ONGC converted in to suspension and revoking the suspension orders of 10 officers of Indian Oil Corporation   Congratulations Comrades , the struggle launched by the Forum in Defence of CPSUs has met a superb success. This has been entirely possible due to the sustained struggle of officers of all CPSUs under the banner of Forum in Defence of CPSUs. The Forum vows to fight to the last till all the victimisation actions are fully revoked by the Govt and Forum stands committed to continue its struggle in future to safeguard and protect the growth of CPSUs.. Oil Sector Officers were victimised for launching their protest against non-implementation of the recommendations of Justice N.J.Rao Committee and its dilution by the Group of Secretaries. It would not be an exaggeration to mention that the additional DA neutralisation for the purpose of fixation as on 01-01-2007 and allowances from 26-11-2008 issued vide DPE order No. 2(70)/08-DPE(WC)-GL-VII/09 dated 02-04-2009 is only because of the struggle launched by the Officers of Oil and Power Sector, as a result of which a committee of Group of Ministers under the Chairmanship of Hon Home Minister  Shri. P.Chidambaram was constituted. This committee decided for the additional 9.4% DA for neutralisation and subsequently which was accepted by the Central Cabinet. The Forum in Defence of CPSUs will fight to the last of its blood to ensure that not a single officer of the Oil Sector is left victimised.

In the third phase of our agitation , Joint Forum held a massive rally on 02-04-09 which started from K.L. Bhawan with a procession of apprx. 4000 Officers moved  for Hon’ble MOC & IT office Sanchar Bhawan , but was stopped at Parliament street. Leaders of Executives’ Associations of MTNL and  BSNL & non-executives Unions of MTNL addressed the gathering. Leaders warned the MTNL management to settle the issues at the earliest, it was also renounced that we will not accept a penny less than 30 % fitment. Later the memorandum was handed over to   Hon’ble MOC & IT.

18-03-2009 On 16/03/2009 a meeting  of MEA Mumbai unit was held in City Telephone Exchange Mumbai. Meeting was attended by a large no. of Office bearers and general members . A  MTNL EA held a meeting with PGM WS . From MTNL EA side Sh. V.K Tomar,GS MEA, Sh. Sunil Kumar,AGS  R.K Mudgil , Org.Sectt. and Sh.R.C. Sharma,VP MEA  Sh. Pankaj Sharma AS MEA WS ,Sh . PK. JAIN ,President GSM unit attended the meeting, with all DS and executive members.of  WS wing

At the very outset, GS stringly raised the issue of poor GSM signals in the NCR  to which PGM   assured that the problem will be completely resolved by  31st March 2009 .
It was pointed out by the Association that the GMs/DGMs in WS are hesitant to take even small decisions and decisions are taken only at PGM level most of the time. PGM agreed with this and promised to take n/a by the end of this month.

 Sh. Nishant Shekhar DS GSM TH explained about the problems related to GSM Billilg,.PGM essured that he will personally visit the billing section and take remedial actions.

Regarding GSM units concern about other matters-PGM told that HQ will look after for the nominations  of foreign trainigs in future. No person  will be repeated in the future for foreigm training.2G moble handset will be provided to the officials on demand basis.,But 3G handsets will be provided only as per requirement. PGM assured that he will personally visit each unit for space and furniture arrangements .He assured for the speedy progress in the 3G project. 200 more 3G BTS will be installed very soon. Hardwares (CTUs) for BSS unit will be arranged  very soon. The tender of receiving Dak from each section is in progress. Tender for AMC of call centre PCs is in progress. 

It was pointed out by the association  that the no. of GMs in WS unit are much than required, which is resulting in delays in file movement unnecessarily.PGM was non commital on this..

GS, MEA, GS, TEAM, AGS & OS MEA met DIR(HR), and discussed following points.

1. Implementation of new pay package with 30% fitment-- he informed that after clarifying the queries of DOT, the case has again been sent to DOT with 5% fitment.he said this decision has been taken in the light of financial position of MTNL.Issue was discussed in detail but nothing positive could come out.
2.First time bound upgradation in 5 yrs including trg from E2 to E3--- he informed that this proposal has been approved by MTNL board, and after the minutes of meeting, orders will be issued.
3--Clarification regarding promotion policy including the issue of offtg promotion insted of looking after arrangment, and financial upgradation in 4 yrs for those who wre promoted on regular basis after oct 2000-- He said that some of issues including FA in 4yrs are almost decided. Clarification is likely to be issued shortly.

4 RRs of Sr MANAGMENT TRAINEES-- He agreed that issue will be discussed in detail with Associations, and view points of Assocition will be accomodated. He assured that with out discussion with association, no further action will be taken on this.

Sir,
Last date of pro-rata pension option is going to be expired on 28-02-09. But, still the decision on pension issue is pending in DoT. We understand that cabinet note is prepared, and is likely to go to cabinet in forthcoming cabinet meeting. Sprit of extending the last date was to see the final decision of govt on pension at par with BSNL, which is still to be decided. So, I request your good self to further extend the last date upto June 09, so that officers can have informed choice in respect of pension.

Meeting with PGM (O)---GS, AGS, & OS met PGM (O) on 30-01-09 and discussed following points—
1.     Victimization of field officers by vig for the wrong policies of managementAssociation brought to his knowledge that officers particularly those who are in cable maintenance are being unnecessarily harassed and victimized by vig for filling the MB on the pattern of Development work. It is known fact that there is common contract for development and maintenance of cable network in MTNL. Association demanded that there should be separate labor contract for maintenance, and till than vig is to be properly instructed by management so that officers are not harassed by vig. Association asked PGM (O) to intervene in the present case of harassment. He assured to look into the matter.
2.     Change of Garuda service connections of officers with dolphin connectionPGM (O) informed that he has called for some information from different areas, and after assessing the information decision will be taken in this regard.
3.      Discussion on generating more revenue in MTNLA healthy discussion on the services and policies of MTNL Delhi took place. PGM (O) was convinced with the suggestions of Association for generating more revenue in MTNL, which is the need of the hour. During discussion he informed that steps are being taken to make 197 services a revenue-generating unit. At present the salary expenditure in special services is in the tune of 100 Cr, but revenue generation is nil. Now, some more services will be included in special services wing, which will generate revenue.

Pension issue status--We have come to know that the point of disparity of scales in MTNL & BSNL has been clarified by MTNL managment, and the cabinet not for pension at par with BSNL has been put up to the MoC, which is likely to be put up in forth coming cabinet meeting on 5th Feb 09. We are trying to meet the people who can help in getting the proposal through in cabinet. Meeting with Dir (fin)--- GS along with AGS, Com Sunil Kr & Org Secy . Com R.K.Mudgil met Dir (fin) on 28-01-09. Following issues were discussed.
1.    Refund from income tax departmentDir (fin) informed that MTNL is going to receive refund of Rs. 510/- crore from IT department shortly. Decision in this respect has been taken, only cheque is to be received.
2.      Current status of pension issueDir (fin) spoke to DDG (Estt), DOT during our discussion, and asked him to let her know the exact movement of the case . DDG (Estt ) told that department of expenditure has diluted its earlier negative comments this time. The most negative point in earlier comments was that if pension in MTNL is given at par with BSNL, then there will be heavy financial burden on Govt. This time, they are silent on this point. But, still there is one negative point, which is disparity in scales in MTNL & BSNL. DDG told that file has been sent to Member (services). Dir (fin) asked DDG (Estt) to take file back from M (S) office, so that this issue of disparity can be clarified by MTNL tomorrow itself. She assured that she would go personally to Dot and provide all clarifications to DOT, and also will discuss with M (F) so that case can be made strong for cabinet.
3.     Clarifications on certain points related to promotion policy including time bound up gradation for those who were promoted bet Oct 2000 and Oct 2004 in 4 yrs instead of 5 years- She instructed to concerned fin persons to put up the case to her shortly, which was received in finance wing few days before only.
4.     Tax on perquisites—Association once again requested her to consider the case of payment of tax on perquisites to IT dept by MTNL on behalf of employees those who are residing in Govt quarters. She said that financial implications in this case are of the tune of 2.6 Cr, which is very difficult to bear by MTNL. Association has requested to further consider the case.

Meeting With CMD, MTNL---General secretary, Com V. K. Tomar along with Com. Jagvir singh, President, Com . R.K.Mudgil Org secy, Com.Sunil Kumar, AGS, Com Satyavir Singh treasurer met CMD on 14-01-09 and discussed following important issues.
1.   Implementation of new IDA scales with 30% fitment as notified by DPE.----Association demanded that new IDA scales be implemented immediately with 30% fitment formula as per the Govt orders. CMD immediately reacted that with 30% fitment to executives & non executives, the PBT (Profit before tax) will dip much beyond 20% which is the ceiling of govt. Association clarified that the ceiling is only for implementing Executives scales not with non executives. If executives’ scales are implemented with 30% fitment, than PBT will dip very less than 20%. But, CMD was of the opinion that management will have to see the total financial implication taking into account the non- executives also. Association told CMD very clearly that pay scales and fitment is very basic and important issue, which can’t be compromised at any cost, because any change in this will lead to recurring loss even after retirement, which can’t be compensated at any stage. After thread bare discussion, CMD appeared to be convinced with our arguments, and assured that the concern of Association will be kept in mind while deciding fitment formula, and efforts will be made to accommodate the views of the Association.
2.   Pension At par with BSNL
—he told that pension case is being persued vigorously in DOT by MTNL CO. Dot is preparing the case for taking it to cabinet.

3.  Services of MTNL—Association raised the issue of poor services of MTNL. CMD said that management is making all its efforts to develop and improve the services of MTNL. He said it is the MTNL who brought some new services Ist in India like ADSL+2, VOIP, IPTV, 3G etc. He said that there are still a large number of middle level management officers, who have not changed there attitude. Customers feel bad treated by concerned staff, and faults remain unattended for a long time. He gave many example of abnormal delay in broadband fault clearance. After prolonged discussion, he said that he is ready to form a steering committee comprising Association, union & management representatives, which will suggest the management what to do and what not to do for the betterment of MTNL.

2. Administrative approval of IDA pay scale approved by MTNL Board--- He informed that only 3-4 days ago he had recieved the minutes of board meeting ,and now in a day or so case will be sent to DoT for its approval.

3.Seniority list of MTNL recruited JTOs- work on this has already started and it will be compeletled shortly.

ALL Area Sec./Div Sec./CHQ office bearers and activists of the Organization at all the levels:
The Govt. has come down heavily on our fraternal friends in the oils sector struggling to get the justified pay scales recommended by the 2nd pay panel committee implemented. The recommendations of the 2nd pay panel have been mercilessly and brutally slaughtered by the all powerful, irrational and senseless bureaucracy of the Govt. of India. Comprehensive job undertaken by the 2nd pay panel to finalize its recommendations relating to pay scales and other related issues of officers of CPSUs in the most scientific and meticulous manner by involving all the experts and professionals from different wings of management, man power deployment and utilization, finance etc. and taking very vital inputs from various renowned consultants has been thrown to the dustbins by the feudal lords, the bureaucrats in the Govt. This job of finalizing the recommendations which was conducted by the 2nd Pay panel in a truly professional manner, taking into considerations all the aspects of critical role of CPSUs in building a formidable national economy and immensely contributing towards building up of strategic developmental and growth oriented infrastructure has been completely watered down by a group of Secretaries completely devoid of scientific analysis and sense. This painstaking and scientific work of the 2nd pay panel spreading over 18 months has been totally diluted by the vested interest bureaucracy in the Govt. in just two sittings.         
Now when the officers of the oil sector have raised their legitimate voice against mighty bureaucracy for their highly irrational and senseless acts, the Govt., instead of going into the crux of the matter to resolve the justified issues, has preferred to invoke repressive colonial draconian laws like ESMA to crush a legitimate, peaceful and democratic struggle. The repressive measures invoked by the Govt. deserve condemnation of the highest order in the most unequivocal terms. It is an attack on legitimate trade union activities on which pillars of democracy are erected. It is ridiculous on the part of the Government to resort to such repressive colonial measures to crush what can be safely termed as legitimate and justified struggle to expose the misdeeds of the bureaucracy in the Govt.
Thus, Comrades, it is the bounden duty of each and every Comrade of MEA to out rightly condemn these repressive measures of the Govt. in the strongest possible manner, thereby conveying it to the Govt. that under no circumstances can this Association allow the Govt. to let loose any kind of repressive measures to slaughter legitimate and just trade union activities by invoking repressive colonial measures in the name of maintaining essential services.
We thus appeal to our Area Sec./Div Sec and activists of the Organization at all the levels to send following Savingram immediately to the Hon’ble PM of India.

The officers of the Oil sector are genuinely and seriously agitated over the arbitrary and high handed manner in which the mighty bureaucracy of the Govt. completely diluted the meticulous and scientific recommendations of the 2nd pay panel constituted by the Govt. to decide pay scales and other related issues of officers of CPSUs. Letting loose of draconian colonial repressive measures to curb and crush democratic trade union movement reminds us of dark Colonial days of the mighty British Empire. We urge upon your Hon’ble self and make a fervent appeal to you to stop the repressive measures forthwith and initiate process of reconciliation not only to restore normalcy but also address the critical and significant issues raised by our agitating fraternal friends from the oil sector failing which we shall be constrained to immediately and actively join our fraternal comrades of the oil sector in their just and legitimate struggle.

07-01-2009 DOT vide order no 40-12/2007-Pen(T) dated 5th Jan. 2009 reiterates that the Govt shall take full responsibility of payment of pension (including family pension) to all the employees of DOT absorbed in BSNL under the statutory provisions of sub rule 21 of Rule 37A of CCS pensionary rules 1972, regardless of whether BSNL is in a position to make pensionary contributions to DOT or not.
